Welcome to The Perfect Creative Studio® (“TPCStudio”, “we”, “our”, “us”). These Terms and Conditions (“Agreement”, “Terms”) govern your access to and use of our website, services, and offerings, including but not limited to video editing and product photography.

By accessing or using any of our services, you (“Customer”, “you”) agree to be bound by these Terms. If you do not agree, you must not access or use our services.

1. Service Scope and Acceptance

You agree to these Terms when engaging with our platform, either by clicking a checkbox during checkout, signing a service agreement, or using our services.

We reserve the right to revise or update these Terms at our sole discretion. Updates will be posted on our website. Continued use of the services after updates signifies your acceptance.

2. Client Media Responsibility

You represent and warrant that you own or have the rights to use all media, music, images, and content submitted to TPCStudio for editing or processing. You are solely responsible for ensuring compliance with intellectual property rights. TPCStudio is not liable for any third-party copyright claims.

3. Subscriptions, Payments & Refunds

Billing: Services may be offered as one-time projects or via recurring subscription models.
Renewals: Subscriptions auto-renew based on the chosen term. Unused hours or credits do not roll over.
Payment: Payment is due upfront. Failure to complete payment may result in service suspension.
Refunds: Payments are non-refundable, unless covered under a stated money-back guarantee or unless agreed otherwise in writing. Partial refunds are not provided for unused periods.

4. Cancellations & Pauses

You may cancel your subscription anytime before the next billing cycle.
Upon cancellation, services continue until the end of the paid term. Account access will be restricted thereafter.
Subscription pauses (if allowed) may be requested once per billing term. Any remaining time must be used within 90 days.

5. Turnaround Times & Delivery

Delivery times vary depending on project complexity, volume, and customer responsiveness. We strive for 1–2 business day delivery on most edits but do not guarantee exact timelines. Urgent projects must be pre-approved.

We do not guarantee that all delivered files will be error-free. You are responsible for reviewing and approving final outputs. Corrections will be made where necessary.

6. Content Ownership & Usage Rights

You retain ownership of your original media and final edited files.
By submitting a project to TPCStudio, you grant us limited rights to use the materials for the sole purpose of delivering the service.
By default, you grant us non-exclusive rights to showcase your edited content in our portfolio, social media, and promotional materials. You may opt-out by notifying us in writing.

7. Restrictions and Prohibited Uses

We reserve the right to cancel any account for misuse, abusive behavior, illegal activity, or violation of these terms, including:

Use of adult/pornographic or illicit content
Misuse of account access or credentials
Soliciting or hiring TPCStudio staff directly without consent

8. Non-Solicitation Clause

You agree not to solicit or engage (directly or indirectly) any employee, contractor, or representative of TPCStudio during the service term and for 12 months following termination. Violating this clause may result in a penalty of $5,000 USD.

9. Limitations of Liability

TPCStudio shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services. Our maximum liability under this agreement is limited to the amount paid during the current billing period.

10. Indemnification

You agree to indemnify, defend, and hold harmless TPCStudio, its owners, contractors, and affiliates from any claims, liabilities, damages, or expenses arising out of your use of our services, violation of these Terms, or infringement of third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Gujarat, India, without regard to its conflict of law principles.

12. Digital Millennium Copyright Act (DMCA)

If you believe any content provided through our platform violates your copyright, you may submit a DMCA notice to:

13. Definitions

Business Days: Monday to Saturday, 09:00 AM – 6:00 PM IST
Customer: Individual or entity purchasing or using services
Services: Video editing, product photography, and related creative solutions provided by TPCStudio
